These General Terms and Conditions (Terms and Conditions) apply to all orders placed through our online shop livoxtech.de. The contractual partner is Gebrüder Kraus GbR, Mozartweg 2, 82538 Geretsried.
Our offer is directed exclusively at entrepreneurs within the meaning of § 14 BGB (German Civil Code); no contract is concluded with consumers (§ 13 BGB). During the ordering process the customer expressly confirms that they are ordering as an entrepreneur in the exercise of their commercial or independent professional activity; we are entitled to verify this status. Direct purchase via the online shop is only possible with a delivery address within Germany.
The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order. By clicking "Order with obligation to pay" you submit a binding order. The contract is concluded upon receipt of our order confirmation by email.
All prices are net prices plus the applicable statutory value-added tax and apply to deliveries within Germany. Shipping costs depend on the shipping method selected during the ordering process and are shown separately before you submit the order:
Deliveries outside Germany are not possible via the online shop, but only after a prior enquiry and a separate quote; additional costs (customs handling, duties, import VAT) may apply and will be stated separately in the quote.
Payment is made on invoice. The invoice amount is due for payment within 14 days of the invoice date without deduction by bank transfer.
Unless expressly designated as binding, delivery times are non-binding approximate values. The delivery time stated on the respective product page is decisive; where no such time is stated, delivery within Germany generally takes place within 2–5 business days after conclusion of the contract. Upon dispatch, the risk of accidental loss and accidental deterioration of the goods passes to the customer when the goods are handed over to the carrier (§ 447 BGB). The goods remain our property until payment has been made in full.
The statutory warranty provisions apply. In addition, the warranty of the respective manufacturer (e.g. Livox, Hesai, Hanwha) applies where granted. The customer must inspect the goods without undue delay after delivery and report obvious defects within seven (7) days of delivery, and hidden defects within seven (7) days of discovery, in text form (e.g. email). If timely notification is omitted, the goods are deemed approved in this respect (§ 377 HGB applies accordingly).
There is no statutory right of withdrawal, as our offer is directed exclusively at entrepreneurs. As a gesture of goodwill we grant a contractual right of return in accordance with our page Returns (business customers).
We are liable without limitation for intent and gross negligence as well as for damage resulting from injury to life, body or health. In the case of simple negligence, we are liable only for breach of material contractual obligations (cardinal obligations), and then limited to the foreseeable damage typical of the contract.
The law of the Federal Republic of Germany applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The place of performance and jurisdiction is — to the extent legally permissible — Geretsried.
